SPILL PREVENTION, CONTROL & COUNTERMEASURES

U.S. Environmental Protection Agency (EPA) regulations mandate that facilities that manage 'oil' in specified quantities develop and maintain a Spill Prevention, Control & Countermeasures Plan (SPCC). For SPCC purposes, 'oil' is defined as products such as gasoline, diesel, motor oil, etc. A facility's SPCC Plan must describe the procedures and equipment in place to minimize the potential for spills, leaks or releases of oil to the environment, as well as describe the reporting and response procedures in the event of a spill, leak or release to the environment. The SPCC Plan must be made available to local, state and federal inspectors and must be prepared within six months of a facility's operation. Failure to implement and maintain SPCC procedures can result in substantial fines and penalties.

WHO NEEDS AN SPCC PLAN

Facilities managing oil in the following volumes are required to prepare an SPCC Plan:
  • Total underground/buried storage capacity is 42,000 gallons or greater
  • Total aboveground storage capacity is 1,320 gallons or greater
  • A single container with a capacity of 660 gallons or greater
  • Or, due to the facility's location, the facility could reasonably be expected to have the potential to discharge oil into a navigable waterway (includes a normally dry wash or storm sewer that eventually drains into a navigable stream)
